1. Acceptance of Terms

By accessing or using the Trait Institute website and the ABIF™ (Adaptive Behavioral Intelligence Framework) assessment platform (collectively, the "Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.

2. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Trait Institute and its licensors. The ABIF™ assessment methodology, the 5-axis behavioral framework, the dynamic UI instruments, and the proprietary scoring algorithms are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, personal, non-exclusive, non-transferable license to access and use the Service for its intended purposes. You may not copy, reverse-engineer, modify, or distribute any part of the assessment instrument or scoring logic without express written consent.

3. Use of Assessments and Results

The Trait Institute assessments are educational and informational tools designed to measure predictive behavioral drivers and conative action styles. They are not medical, psychological, or psychiatric diagnostic tools.

• For Individuals: The results provided are interpretations based on your inputs and our algorithms. We do not guarantee employment, career success, or personal relationships resulting from these profiles.
• For Organizations: While our platform offers predictive job role fitting, the ultimate hiring and personnel decisions remain the sole responsibility of the employer. Trait Institute shall not be held liable for any hiring, termination, or management decisions made in reliance upon our assessment reports.

4. Payment, Subscriptions, and Refunds

Certain features of the Service (such as Enterprise dashboards and premium Deep Analysis reports) require payment. All payment transactions are processed through our secure third-party provider, Stripe.

Because our premium reports and digital insights are delivered instantly upon purchase, all sales are final and non-refundable unless required by law. Enterprise subscriptions are billed monthly or annually and may be canceled at any time, but no prorated refunds will be issued for partial terms.

5. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account. You are responsible for safeguarding your password and access codes. You agree not to disclose your password to any third party.

6. DMCA & Content Protection

Trait Institute respects the intellectual property rights of others and complies with the provisions of the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe your copyright-protected work was posted on our site without authorization, you may submit a DMCA Notice to our designated agent at legal@traitinstitute.com with the following elements:

• Your full name, mailing address, telephone number, and email address;
• A description of the copyrighted work that is claimed to be infringed;
• A description of where the allegedly infringing material is located on our site;
• A statement that you have a good-faith belief that the use is not authorized;
• A signed statement, made under penalty of perjury, that the information in your notice is accurate.

7. Limitation of Liability

In no event shall Trait Institute, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use or alteration of your transmissions or content.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
